Dear Board Members:
Despite the request in our letter dated March 15, 2010, that the Board make an initial determination to amend the
Local’s Bylaws to adopt a 3rd party vendor for the next (and any subsequent) election, we have received no reply
from Secretary Miskowski, or from the Executive Board as a whole.
Notwithstanding, we are advised that President Roeder has appointed a 3 member panel to study only the cost
effectiveness of this proposed election change, ignoring the more critical members’ rights of transparency and
fairness.
This panel consists of the Election Chairman and 2 Executive Board Members. We vehemently object to this panel
formation. To preclude charges/complaints we strongly recommend the Board familiarize themselves with the
Constitution and Local Bylaws which expressly forbid the President from supervising the Election Committee, directly
or indirectly, and: inclusion of any member who is a candidate for office or who was a member of the Election
Committee.
As a matter of course, Members for Change has solicited independent bids from four reputable third party election
vendors.
Enclosed please find the quotes from two: True Ballot Inc. ($ 5,000.00 plus printing, postage and mailing) and
Election Trust ($5,725.00). We also received a verbal quote from the American Arbitration Association. Their quote is
approximately $15,000.00. We await the (4th) quote from Election America. Please note: on-line and telephone voting
are included. Kindly review these quotes in detail; they provide Local 1033 with advantages both financial and with
regard to anonymity.
To facilitate a number comparison, we enclose a copy of the ‘Adjusted CWA Local 1033 Financial Report’ dated
February 5th, 2009. Please note the actual expenditure for the October, 2008 election: $23,400.00.
In terms of cost effectiveness there is no dispute. As to the critical concerns of transparency and fairness, we
recommend Executive Board Members contact the vendors so that informed decisions can be made relative to the
best interest of the members of this Local. The Board will be remiss if it does not conduct an impartial and sincere
study of the advantages offered by these firms and indeed, others.
Finally, of special import: both the MOA (Memorandum of Agreement) and the current Pension Board election have
been conducted by third party vendors; respectively, the American Arbitration Association and Election America.
In closing, we appeal again to the CWA Local 1033 Executive Board members to exercise their fiduciary and moral
responsibility to the members of this Local.
This letter (and enclosures) is forwarded to the National Union.
We look forward to hearing from Secretary Miskowski and/or the Executive Board in the immediate future. As full dues
paying members, we deserve a formal and thoughtful reply.
